However, as the company indicates on its site, the service includes SSL-certificates for its servers (https://support.wix.com/en/article/about-ssl-and-https).

WIX default cookies

As opposed to a regular website host, the WIX platform places certain cookies in the browser by default. Those placed by the main product are listed in the link below, plugins and added WIX products may alter the list of Cookies placed by WIX itself. 

It is apparently not possible to opt out of the use of these cookies, but as WIX themselves explain in the below document, it is unclear if these cookies can/will all be classified as technically necessary. If not, they may require an explicit opt-in from the users, not merely a notification, under, especially, the upcoming e-Privacy regulation, and in particular because some of the cookies appear to be stored on the user’s system until manual deletion. WIX stated GDPR (non-) compliance

In addition to the cookie problem, WIX declares that despite its efforts towards GDPR compliance (esp. with regards to the right to request personal information, right to delete personal information), not all GDPR requirements are necessarily fulfilled by WIX “out of the box.” Depending on the implementation of the website, additional measures will probably have to be taken for GDPR compliance, like making sure that data collected through, if used, services like WIX Code (a more flexible development platform) or WIX HTML (a way to add custom code to WIX sites) does not contain personally identifiable information. According to the documents provided by the company, there is currently no automated way of complying with GDPR data subject requests for these products.

 

Contact form

 

If you submit inquiries to us via our contact form, the information provided in the contact form as well as any contact information provided therein will be stored by us in order to handle your inquiry and in the event that we have further questions. We will not share this information without your consent.

Hence, the processing of the data entered into the contact form occurs exclusively based on your consent (Art. 6 Sect. 1 lit. a GDPR). You have the right to revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions – in particular, retention periods.

 

Processing of data (customer and contract data)

 

We collect, process and use personal data only to the extent necessary for the establishment, content organization or change of the legal relationship (data inventory). These actions are taken on the basis of Art. 6 Sect. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual actions. We collect, process and use personal data concerning the use of our website (usage data) only to the extent that this is necessary to make it possible for users to utilize the services and to bill for them.

The collected customer data shall be eradicated upon completion of the order or the termination of the business relationship. This shall be without prejudice to any statutory retention mandates.

On this website, we have activated the IP anonymization function. The full IP address will be transmitted to one of Google’s servers in the United States and abbreviated there only in exceptional cases. Demographic parameters provided by Google Analytics

This website uses the function “demographic parameters” provided by Google Analytics. It makes it possible to generate reports providing information on the age, gender, and interests of website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data.”

 

Google Analytics Remarketing

 

Our websites use the functions of Google Analytics Remarketing in combination with the functions of Google AdWords and Google DoubleClick, which work on all devices. The provider of these solutions is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

This function makes it possible to connect the advertising target groups generated with Google Analytics Remarketing with the functions of Google AdWords and Google DoubleClick, which work on all devices. This makes it possible to display interest-based customized advertising messages, depending on your prior usage and browsing patterns on a device (e.g. cell phone) in a manner tailored to you as well as on any of your devices (e.g. tablet or PC).
